Terms of Service
These Terms of Service ("Terms") govern your use of Cream Soda (the "Service"), an AI-powered music generation platform. By creating an account or using the Service, you agree to these Terms.
1. Overview
Cream Soda allows you to generate, preview, and manage AI-generated music tracks using a token-based system. Some features are available for free, while others require a paid subscription powered by Stripe.
2. Eligibility & Accounts
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
Authentication and account data are handled through Supabase. You agree to provide accurate information and to promptly update your account details if they change.
3. Subscriptions, Tokens & Billing
Cream Soda offers subscription plans (such as Basic, Pro, and Max) that provide monthly allowances of generate tokens and streaming tokens. When you purchase a subscription, your payment is processed by Stripe, and your plan limits and token balances are managed in our system.
- Subscriptions renew automatically at the end of each billing period unless you cancel.
- When you upgrade your plan, additional tokens may be added to your account based on the new plan limits.
- We generally do not offer refunds once a billing period has started, except where required by applicable law.
- In addition, once you have used any generate token or streaming token (for example, by generating or streaming at least one track in the current billing period), refunds for that period are not available, except where required by applicable law.
You can view and manage your subscription from within the app (e.g., the Subscription tab and pricing page). Cancelling your subscription will stop future renewals; you will typically retain access until the end of the current billing period.
4. Use of the Service
You agree not to misuse the Service. In particular, you must not:
- Use automated scripts or abuse the API to circumvent rate limits or token limits.
- Upload, generate, or share content that is illegal, hateful, threatening, defamatory, or that infringes the rights of others (including copyright, trademark, or privacy rights).
- Attempt to reverse engineer, decompile, or otherwise access the underlying models, systems, or security mechanisms.
- Impersonate another person or misrepresent your affiliation with any artist, brand, or entity.
We may suspend or terminate access to the Service if we reasonably believe that you have violated these Terms or are using the platform in a way that could harm us, other users, or third parties.
5. Generated Music & Content
When you use Cream Soda, you may provide inputs such as prompts, descriptions, or other parameters ("User Input"). Based on this input, the Service generates audio and related assets ("Generated Music").
Subject to these Terms and any applicable law, you may generally use the Generated Music for personal or commercial purposes, including in advertising, marketing, and promotional materials. However:
- We do not guarantee that any Generated Music will be unique or free from claims of infringement by third parties.
- You are solely responsible for ensuring that your use of Generated Music complies with any applicable laws, platform rules (e.g., streaming services), and third-party rights.
- We may use anonymized or aggregated information about prompts and usage patterns to improve the Service.
6. Intellectual Property
All rights, title, and interest in and to the Service (including the website, branding, UI components, underlying models, and code) are owned by us or our licensors. Except for the limited license granted to you to use the Service, no other rights are transferred to you.
You retain any rights you have in your own User Input and any uploads you provide (such as cover art or lyrics), but you grant us a non-exclusive, worldwide, royalty-free license to process that content as needed to operate and improve the Service.
7. Third-Party Services
We rely on third-party services to provide parts of the functionality of Cream Soda, including, but not limited to:
- Supabase for authentication, database, and storage.
- Stripe for payment processing and subscription billing.
Your use of Stripe and other third-party services may be subject to their own terms and privacy policies. We are not responsible for the actions or omissions of these third parties.
8. Logs, Token History & Security
To keep the Service reliable and to help you understand how your subscription is used, we may keep limited records about your activity, such as token usage history (for example, when a generate or streaming token was consumed) and high-level usage events (such as creating music, saving playlists, or changing plans).
In addition, our infrastructure providers (including Supabase, Stripe, and Sentry) may collect technical logs such as IP address, browser information, and error details for security, abuse prevention, and troubleshooting. These logs are generally not used to build marketing profiles about you and are processed in accordance with our Privacy Policy.
By using the Service, you agree that we may process this information to operate, secure, and improve Cream Soda, and to respond to support or billing inquiries (for example, by showing you recent token usage in your account).
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties, express or implied, about the reliability, accuracy, or suitability of the Service, or that it will be uninterrupted or error-free.
We do not guarantee that Generated Music will be unique, non-infringing, or suitable for any particular commercial purpose. You assume all risks associated with your use of the Service and any content you create with it.
10. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service will be limited to the amount you paid to us for the Service in the twelve (12) months before the claim arose, or, if you have not paid anything, to one hundred (100) US dollars.
11. Changes to the Service or Terms
We may update the Service and these Terms from time to time, for example to add new features, improve security, or comply with legal requirements. When we make material changes, we will provide reasonable notice, such as updating the date at the top of this page or notifying you in the app.
Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service.
